Contract for suppliers

This document summarises the terms governing the relationship between FRANCLAU MARKETING, S.L. (Tax ID B-67596486), owner of Visitar Bodegas, and the suppliers (wineries and businesses in the wine, cava and related beverages sector) that publish and manage their experiences on the platform.

First — Parties

The contract is established between Franclau Marketing, S.L., as owner of the platform, and the supplier that requests to register and manage its wine-tourism experiences on Visitar Bodegas.

Second — Duration

The contract is intended to be of indefinite and stable duration. Either party may terminate it by giving written notice at least one month in advance.

Third — Description of the service

The supplier has a user account from which it publishes and manages its activities, opening hours and availability. The supplier undertakes to honour confirmed bookings and may not cancel them with less than 24 hours' notice, except in cases of demonstrable force majeure.

Fourth — General terms

Improper use of the platform will result in warnings; repeated breaches may lead to automatic termination of the contract. Serious breaches will entitle Visitar Bodegas to terminate the contract immediately.

Fifth — Financial terms

The applicable financial and billing terms correspond to the plan selected by the supplier and are reflected in its user panel. The retail price of each experience may not be higher than that offered by the supplier through its other channels. Invoicing is issued monthly, on the 1st, for the tours that took place in the previous month (the date of the tour counts, not the date of the booking).

Sixth — Data protection

Data processing is carried out in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD). You can find further details in our privacy policy.

Experience companies (suppliers that are not wineries) receive from Visitar Bodegas the contact details of their customers (name, email, phone and pick-up point) in order to provide each booked experience. They undertake to process them as controllers under the GDPR, to use them exclusively for that booking, not to share them or use them for marketing without the customer’s consent, to apply appropriate security measures and to delete them once they are no longer needed. Wineries do not receive customers’ personal data.

Seventh — Acceptance

Acceptance of this contract implies the supplier's agreement with all of its terms, as well as with Visitar Bodegas's legal notice, terms of use and privacy policy.
